International Consultant

Nature of the consultancy:

To contribute to the improvement of the Centre for Combatting Trafficking in Human Beings’ management and cooperation with the specialized anti-TiP prosecutorial bodies, thus contributing to the task-force approach among them. The second objective is the improvement of the CCTiP’s fulfilment of it’s mission in investigating and prosecuting TiP and related crimes.

Project Context and Scope:

1.On 6 September 2005 the Moldovan Government jointly with the U.S. Government, have signed the Amendment III to the Letter of Agreement on Narcotics Control and Law Enforcement of 28 August 2001. This document has been used as a basis for the establishment of the Centre for Combatting Trafficking in Persons (CCTiP), which is currently the sole police agency specialized in combatting trafficking in persons (TiP) and related crimes. Since then CCTiP has become in theory as well as in practice the main law-enforcement agency, covering over 80% of investigations of TiP and related cases nation-wide.

2. In the meanwhile, there were established prosecutorial and judicial structures, which are specialized in the investigation and prosecution of TiP and related crimes. CCTiP’s role in this specialized setting, however, remains crucial. The reason for having a quite special position within this anti-TiP law-enforcement setting is the fact that CCTiP covers the criminal investigations part. Most contacts with the traffickers and victims, as well as the protection of their rights and freedoms fall within the competences of CCTiP. The collection of evidence is also mostly performed by CCTiP. This last fact taken alone oftentimes determines the success of prosecution of each particular TiP case.

3. At the same time CCTiP was conceived as a task-force unit, which was supposed to work both as an analytical unit in relation to TiP crimes, as well as cooperate on a permanent basis with the prosecutorial bodies specialized in combatting TiP. This cooperation includes dedicated premises for specialized prosecutors within the CCTiP office, who work jointly with the investigators on a case-by-case basis. Currently there are 10 office spots dedicated to prosecutors within the CCTiP office. For this reason, it is crucial to both have a strong CCTiP, and to secure its efficient cooperation with the prosecutors.

4. At the present moment, for a variety of reasons, it is often not the case. On the one hand, CCTiP itself is exposed to high staff turnover, unsatisfactory collection of evidence and cooperation with the prosecutors. This affects not only the rights of victims, witnesses, but also the speediness and efficiency of investigations. The current state of cooperation with the prosecutors has several reason mentioned above, as well as the current hierarchical culture in the practical relationships between the CCTiP officers and the prosecutors. This impedes the optimal implementation of the task-force approach among the two groups.

5. Effective police leaders become very skilled at responding to challenges. Most leaders understand the fluid conditions in which their department operates even as they compete to standardize operations. They also know there are both internal and external forces to which they must adapt and grow in order to remain effective. The law enforcement world is ever-changing as police leaders must be able to recreate the way of conducting policing. Agencies are seeing a new generation of police officers and significant opportunities in the availability of new technology. The traditional organizational models of policing need changing and this can only be done through effective leadership.

6. Therefore, in order to support the further strengthening of cooperation between CCTiP officers and anti-TiP prosecutors and to improve the current task-force approach, IOM is willing to bring in an in-house adviser to CCTiP premises, who would have the double role of management and operational consultant. The consultant would be continuously present within CCTiP premises on a full-time basis during a period of 4 weeks.

7. Bringing in an international consultant is crucial for the attaining the objectives set. It is important that in his/her facilitator role, the consultant will have a neutral background and that he/she brings a fresh perspective on management and operational anti-TiP issues, thus lacking the background strains that might have impended a meaningful progress towards the goal of this exercise.

8. Subsequently IOM will conduct an evaluation of the consultant’s work by collecting anonymous evaluation forms from the CCTiP staff and the specialized anti-TiP prosecutors.

Specific objectives:

• Improvement of CCTiP efforts in combatting TiP by joint coordination among the specialized anti-TiP law-enforcement agencies;

• Strengthening capacities of the governmental institutions in preventing and combating TiP;

• Ensuring information exchange and accessibility of information at the national and international levels in the field of preventing and combating TiP;

• Continuous improvement of strategic and operational anti-trafficking feedback by adjusting it to the new TiP tendencies;

• Ensuring special protection of victims of trafficking (VoTs) willing to participate as witnesses within the criminal proceedings;

• Enhancing the international cooperation in TiP cases.

Specific tasks to be performed by the consultant:

Under the direct supervision of IOM Prevention and Protection Programm Coordinator and in close cooperation with the project team and other relevant agencies and institutions involved in combatting TiP and related crimes, the consultant will:

1. The advisor will recommend and incorporate the best practices in:

• building a team approach to investigation,

• devising successful strategies in investigation and case management,

• developing staff skills in using negotiated plea agreements effectively, especially with informants, and ensuring a human-rights based cooperation from witnesses and victims, while having a strong focus on their protection;

• obtaining evidence and other legal assistance from other countries on seizure of assets, particularly with Arabic states and Cyprus (would be considered an asset)

• applying measures to protect endangered witnesses,

• investigating financial aspects of the criminal activity to trace and identify illegal proceeds for confiscation.

2. The consultant will provide mentoring for the management and the CCTiP staff, as well as the specialized prosecutors based within CCTiP.

3. The consultant will identify the main management and operational issues affecting CCTiP’s work, and its efficient cooperation with the specialized prosecutorial units;

4. He/she will facilitate the process of drafting guidelines and protocols to promote best practices in all phases of investigation and prosecution, and to ensure that CCTIP investigators and prosecutors are working in tandem towards a common goal;

5. The consultant will produce a final report, describing the main issues, findings and recommendations towards attaining the objective of the consultancy. The final report will set the baseline for subsequent improvement of CCTiP’s performance and cooperation with the specialized anti-TiP prosecutorial units.

Timetable of deliverables:

2 days Conduct preliminary meetings with the main stakeholders for a closer definition of consultancy goals and strategy

2 days Develop a two-page concept paper describing the overall strategy of attaining the consultancy goals

20 days Provide in-house consultancy services according to the goals, tasks and description mentioned in pp. 5-8 of this ToR

4 days to develop the Guide/Report with recommendations on CCTiP’s functioning, management, and role within the MoI system and its presentation to CCTiP management

2 days to develop the Report on the conducted work for IOM

Performance indicators for the evaluation of results:

The performance of work will be evaluated based on the following indicators:

• Completion of tasks specified in ToR.

• Compliance with the established deadlines for submission of deliverables.

• Quality of work (consideration of international human rights standards, precision, comprehensiveness, accuracy).

Required Qualifications and Experience:

Education, Experience and/or skills required:

- University degree in the field of Law, Criminal Justice, or other relevant fields;

- At least 10 years of practical experience, out of which at least 4 in management positions in law-enforcement bodies specialized in combatting trafficking in persons;

- A very good command of English. A close to native command of Romanian or Russian is strongly preferred.

- A clear record of previous management and operational activity;

- At least 5 years of international consultancy experience;

- Proven understanding of international and preferably European anti-TiP standards;

- Experience in drafting studies, normative documents and performing analysis of complex legal and investigative issues is an advantage;

- Experience of work with international organizations and, particularly with UN Agencies would be an asset.

- Excellent communication and coordination skills;

- High responsibility, self-motivation and self-management, efficiency and tendency to the achievement of result.

- High level of discretion, integrity, and sensitivity and respect for diversity.

Travel required:

It is expected that during the assignment, the consultant will travel to Chisinau and work in CCTIP 4 weeks (20 working days).

The cost of international round trip tickets and accommodation will be covered by IOM.

The consultant will be responsible for costs related to obtaining visas and travel insurance if needed. Unless provided by the TOR, IOM will not reimburse costs not directly related to the assignment outcome. The contract does not allow payment of off-hours, medical insurance, taxes, and sick leave.

Translation (if needed) will be ensured.

Meals and other per diem will not be provided.

Reporting requirements:

The assessment will be carried out under the supervision of IOM Moldova Prevention and Protection team and close coordination with CCTIP management and all activities and deliverables undertaken by the consultant shall be discussed and planned accordingly.

To achieve the assignment objectives, IOM will facilitate the contact with relevant stakeholders and will provide relevant data and documents.

The Consultant will use his/ her own computer to perform the tasks specified in the contract.
